Terms of Use and Licence (EULA) — HIFILAT Console

HIFILAT Console for macOS
Version 1.0 · In effect since: September 2026 · Last updated: October 2026

This is an informational translation. The Spanish version governs (see §13).

This End User Licence Agreement ("Agreement") is a contract between you and HIFILAT SpA, RUT 78.449.278-8, with address at Antonio Bellet 193, Oficina 1210, Providencia, Santiago, Chile ("HIFILAT", "we"). By downloading, installing or using HIFILAT Console (the "Application"), you agree to be bound by this Agreement.

1. What the Application is

HIFILAT Console is a per-application audio mixer for macOS: it gives each application its own volume and equalization and sends its audio to the output device or devices you choose. It runs entirely on your Mac.

System requirement: macOS 14.4 or later. The Application relies on Apple operating-system interfaces (Core Audio Process Taps); if Apple modifies, restricts or removes them in future macOS versions, certain features may change or become unavailable. We will make reasonable efforts to adapt, but that is beyond our control.

2. Licence granted to you

Subject to this Agreement, HIFILAT grants you a personal, non-transferable and non-exclusive licence to install and use the Application on Apple-branded devices that you own or control, in accordance with the Usage Rules of the App Store Terms of Service where obtained through that channel.

3. What you may not do

You agree not to:

4. System permissions and your audio

To function, the Application requires the macOS System Audio Recording permission, which grants access to the audio of the applications you route. You may optionally grant the Microphone permission, solely for the level meter.

The Application does not record, store or transmit your audio. Processing happens in real time in your Mac's memory. Details are in the Privacy Policy, which forms an integral part of this Agreement.

You may revoke both permissions at any time in System Settings; if you revoke the audio permission, the Application will stop receiving sound.

5. Intellectual property

The Application, its code, design, interface, name and trade marks are the property of HIFILAT SpA and are protected by intellectual and industrial property law. This Agreement licences the use of the Application; it does not transfer ownership. The settings, correction curves and preferences you create are yours.

6. Purchases, refunds and right of withdrawal

Console Pro can only be purchased inside the Application obtained from the Mac App Store.

Should we enable a purchase outside the App Store in the future, we would update these Terms before doing so.

None of the above limits your statutory guarantee or the consumer-protection rights your country grants on a mandatory basis.

7. Warranty and limitation of liability

The Application is provided "as is", without implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by law.

To the maximum extent permitted by law, HIFILAT's total liability under this Agreement is limited to the amount you paid for the Application. Not limited are wilful misconduct (dolo), gross negligence, personal injury, any liability that the law does not allow to be limited, and mandatory consumer rights, including the statutory guarantee. If you are a consumer in Chile, the European Union or the United Kingdom, the limit in this paragraph does not apply to you, and we are liable under the applicable consumer-protection law.

8. Termination

This Agreement applies while you use the Application. It terminates if you stop using it and uninstall it, or if you materially breach these terms. Termination does not affect the settings and files residing on your Mac, which remain yours.

9. Conditions required by Apple (App Store)

Where you obtain the Application from the Mac App Store, the following Apple-required conditions also apply:

1. This Agreement is between you and HIFILAT SpA, not Apple. HIFILAT alone is responsible for the Application and its content.
2. Scope of licence: the licence is non-transferable and limited to use on Apple-branded products you own or control, under the Usage Rules of the App Store Terms of Service. Where Apple allows it, other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts may also access and use the Application.
3. Maintenance and support: the sole responsibility of HIFILAT. Apple has no obligation whatsoever to furnish maintenance or support services.
4. Warranty: HIFILAT is solely responsible for any warranty. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
5. Product claims: HIFILAT, not Apple, is responsible for addressing any claims relating to the Application (product liability, failure to conform to legal or regulatory requirements, and consumer-protection or privacy claims).
6. Intellectual property: in the event of a third-party claim of intellectual property infringement, HIFILAT will be responsible for its investigation, defence, settlement and discharge.
7. Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any prohibited or restricted party list.
8. Contact: HIFILAT SpA, Antonio Bellet 193, Oficina 1210, Providencia, Santiago, Chile · email contacto@hifilat.com. Send any questions, complaints or claims about the Application there.
9. Third-party terms: you must comply with applicable third-party terms when using the Application.
10. Beneficiaries: Apple and its subsidiaries are third-party beneficiaries of this Agreement and will have the right to enforce it against you.

10. Data protection

Data processing is governed by the HIFILAT Console Privacy Policy, which forms an integral part of this Agreement. In short: the Application does not collect data.

11. Changes

We may update this Agreement. We will publish the current version with its number and date. Material changes will be communicated together with the Application version that introduces them. A change that reduces your rights will not apply to a purchase you have already made unless you accept it.

12. Governing law and jurisdiction

This Agreement is governed by the law of the Republic of Chile. If you are a consumer: you keep the protection of the mandatory rules of the country where you habitually reside; in Chile, you may turn to SERNAC and sue before the Juzgado de Policía Local of your domicile or ours, at your choice (art. 50 A of Law 19.496); in the European Union, the European Economic Area or the United Kingdom, you may sue before the courts of your domicile, and may only be sued there; in another country, you may also sue where the law of your country allows. If you are not a consumer, the ordinary courts of Santiago, Chile, have jurisdiction.

13. Language

The original version is written in Spanish. Any translation is provided for information only; in the event of a discrepancy, the Spanish version prevails.
